Is it illegal to send a employee home without pay in the state of Virginia?

An employer can send an employee home without pay, provided they are hourly or non-exempt because the employer does not have to pay for time not worked. Exempt employees can be sent home, but must be paid.

However, a company must have a valid or legal reason to send an employee home. Valid reasons are, not enough work, change in schedule, power outages, safety violation, and violations of rules. If you do not have a valid reason for sending an employee home it is probably not legal to do so.

Virginia does not have any specific law in regard to this topic.
