Overtime Pay

Does an employee get paid overtime on Saturday if he/she was off on Friday and gets straight paid by sick leave? Her total worked hours were 32 plus 8 hours sick leave and 8 hours on Saturday. Thanks.

The federal Fair Labor Standards Act (FLSA) requires employers to pay overtime to non-exempt employees at a rate no less than one and one-half their regular rate of pay for all hours actually worked over 40 in a given workweek. The act doesn’t require overtime pay for weekends or compensated time not actually worked. The employee in question should receive their regular rate of pay for all 48 hours, 40 hours straight time plus 8 hours sick leave. The reason being is because the employee actually worked only 40 hours. The sick leave is not considered time actually worked; thus, no overtime pay is required.
