Maternity/Paternity Leave

We have a business of less than 50 employees, but recently we have had an employee become pregnant and another employees wife become pregnant. If we decide to create a policy that says take up to 12 weeks of unpaid leave for maternity do we have to offer the same policy for paternity?

Offering maternity leave outside of leave entitlement laws is very generous of an employer. It’s a good benefit to offer and a great way to retain qualified staff. It’s best practice to offer parental leave, not just maternity or paternity leave. Federal law, specifically Title VII of the Civil Rights Act, prohibits discrimination based on gender. Thus, offering a benefit to only female employees, such as maternity leave, would be considered discrimination.
