Forced Vacation Time

If an employee is idle due to a slowdown in workload – can an employer make the employee utilize vacation time during this period?

Yes, employees may be required to use vacation time during slow operating periods, as long as this is done consistently and without discrimination. Employers are not required by law to provide paid or unpaid vacation time and if these benefits are provided, the employer is free to establish policies regarding when vacation can or cannot be used, as well as when it must be used (such as during a work slowdown). To ensure consistency, any stipulations on the use of vacation should be included in the organization’s written vacation policy.
