alcohol on the job

we have an employee that has a problem with alcohol. we have found out that he has been drinking on the job. what are the legal steps that we need to take in order to terminate him?

Your first step should be to check your company’s alcohol use policy. This should clearly state that alcohol may not be used in the workplace and detail the steps you will take if the employee is suspected of using or being under the influence of alcohol on the job, including what constitutes “reasonable suspicion”, that an alcohol test will be required, how this testing will be carried out, and what the employee’s status will be while waiting for the test results (i.e. paid or unpaid suspension, etc). Also, the policy should clearly state what the consequences will be if the test is positive for alcohol.

After reviewing the policy, be sure to document the facts (employee observed drinking beer, etc.), and then proceed as stipulated by your policy.
