Hourly Probation Compensation

Can you please tell me if it is legal in California to NOT pay an hourly employee Holiday pay while they are on probation?

Neither federal nor California law requires that an employer provide its employees with paid holidays. Such a policy or practice is considered a matter of agreement between the employer and employee.

Additionally, California doesn’t require employers to close their businesses on holidays, give employees the day off for a specified holiday, or pay employees a premium for working on holidays.

An employer is within its right to adopt a policy requiring employees to pass a probationary period in order to be eligible for holiday pay benefits.
