Form I9

Is a person considered an employee within the 3 days prior to completing the Form I9?

Form I-9 verifies an individual’s employment eligibility. The U.S. Citizenship and Immigration Services requires newly hired employees to complete and sign the form no later than the first day of employment. Employers or their authorized representatives must complete their appropriate sections of the Form I9 within three business days of an employee’s first day of employment. So, yes, an individual is considered an employee during the three day period that the employer has to complete the Form I9.
