Unused Vacation pay in Mississippi

If an employee, in Mississippi, resigns are they eligible to get paid for remaining unused vacation time if the Employee handbook states “Remaining vacation time will not be paid unless required by applicable law”

There is no current law in Mississippi regarding the payout of vacation time upon separation of employment. Thus, it’s assumed employers are able to establish such policies at their discretion. Bear in mind, an employer must abide by its own policies and established practices.
