How many hours can an employee work per day in a power plant, non-union?

The Occupational Safety & Health Administration establishes standards for employers to provide their employees with safe and healthful working conditions.

Under the General Duty Clause of the Occupational Safety and Health Act (OSHA), employers are required to provide their employees with a place of employment that is free from recognizable hazards that are causing or likely to cause death or serious harm to employees. Thus, an employer has an obligation to provide a workplace free of conditions or activities that either the employer or industry recognizes as hazardous. Moreover, employers must take reasonable measures to prevent such hazards.

OSHA doesn’t limit the number of hours an adult employee can work in a single day or workweek. Instead, OSHA encourages employers to limit the use of extended shifts (8 hours or more) and increased number of working days due to the potential for worker fatigue, stress and lack of concentration. OSHA also warns that such health effects lead to an increased risk of operator error, injuries and/or accidents.

There are justifiable safety concerns when a power plant employee works over 8 hours in a shift. An employer must be aware of the safety risk this entails and should take any and every reasonable action to either prevent an employee from having to work excessive hours or, at least, provide the employee with additional breaks as necessary.

OSHA prohibits employers from retaliating against employees who file safety-related complaints or who otherwise exercise their rights under the Act.

Just to note, the federal Fair Labor Standards Act (FLSA) establishes compensation guidelines for employees. Under the FLSA, non-exempt employees must be paid for every hour worked and receive overtime pay for hours worked over 40 in a workweek at a rate not less than time and one-half their regular rates of pay.
