Can an employer in Massachusetts require employees work overtime?

Employers in Massachusetts can require most employees to work overtime with or without advanced notice. Furthermore, there is no limit to the number of hours an employee can work under either Massachusetts or federal law.

The only exception is for nurses. Under Massachusetts law, except in emergency situations, nurses providing patient care in a hospital setting cannot work more than 12 hours in any 24 hour period.

Under both Massachusetts and federal law, non-exempt employees must be paid one and one-half times their regular hourly rate for all hours worked in excess of 40 hours in a given work week.
