Promotion 90 day probation period

Hello, My brother was given a promotion from Technician to Job Foreman. At first he was told he would get back paid from the start then later on was told he would get back pay from when his 90 day probational period ended. Was his employer legally responsible for any increase or anything during that 90 days? Since the company is late by over a month in giving him his entitled raise can he charge penalty fees or put liens on company belongings until he receives his back pay?
