Time Off for Salaried Employees

What is the policy for salaried employees taking time off (partial/full day) for personal reasons, doctor’s appointments, funeral, etc.? Can employees be required to take PTO for the time missed?

Paid time off (PTO) policies are generally at the discretion of the employer in the private sector. Employers are able to adopt policies granting employees, exempt or non-exempt, time off for specified reasons (i.e. sick, vacation, bereavement). Such policies often include procedures for requesting time off, accrual methods, blackout periods, and any other information related to PTO administration.

Employers are able to require employees to use PTO in any increments for any time off from work. It’s common practice for exempt employees to take off a few hours without having to use their PTO. However, this is a matter of company policy/practice and is not required by law. The practice is typically used with exempt employees who often work beyond their scheduled hours without additional compensation.

It’s important to mention deductions from exempt employees’ salaries are permitted in limited circumstances prescribed by the federal Fair Labor Standards Act (FLSA). So, once an exempt employee exhausts his/her PTO bank but takes time off, the compensation requirements set forth under the FLSA must be adhered to.

Only certain full-day deductions from exempt employees’ salaries are permitted. Half-day or partial-day deductions are never permitted when an employee is absent half a day for a medical appointment or other personal reasons.
